1. Overview
These terms form the Hire Agreement between Say Cheese Co. (ABN 92 281 051 220), a photobooth hire business based in Sydney, NSW ("we", "us"), and the client named on the booking ("you"). By paying the Deposit and/or confirming a booking with us, you agree to the terms set out below, including the deposit and cancellation terms.
2. Enquiries & bookings
Submitting an enquiry through this website does not itself confirm a booking. A booking is only confirmed once we've agreed on your event date, package and pricing directly with you and the Deposit has been received. Availability is not guaranteed until the Deposit is received — we hold one event per date, and confirming your booking means we turn away other enquiries for that date.
3. Date hold, deposit & payment
The $99 date hold. A date hold is not a booking and is not the Deposit. Paying $99 holds your date for 7 days while you decide, and during those 7 days we will not take another booking for it.
You may ask for the $99 back at any time within those 7 days and we will refund it in full — reply to your receipt or call us. If you book within the 7 days, the $99 comes off your total.
If you neither book nor ask for a refund, then at the end of the 7 days the date is released and becomes available to other clients, and your $99 stays on your account as credit toward a future booking. The date and the money are separate: the credit lasting does not mean the date is still held.
The Deposit. A deposit is required to confirm and hold your date; your booking is not confirmed until it's received. The balance of your total fee is due on or before your event date and must be in cleared funds before we begin setup — we may decline to commence if it hasn't cleared.
Cooling-off: you may cancel within 48 hours of paying your Deposit for a full refund of the Deposit.
Non-refundable date-hold: after the 48-hour cooling-off period, the Deposit is non-refundable, because it secures your date and we decline other bookings for it.
Transferable & reschedulable: if your plans change, your Deposit may be transferred to a new date or to another person within 12 months of your original event date, subject to our availability. A reschedule is not a refund.
4. Cancellation & postponement
Your Deposit is treated under clause 3 above. If you cancel, the balance of your fee is treated as follows:
- 30 or more days before your event: the balance is refunded in full.
- 14–29 days before your event: 50% of the balance is payable / non-refundable.
- Fewer than 14 days before your event, or on the day: the full fee is payable / non-refundable, as the date was held and other bookings were declined.
Postponement: we'll always try to move your booking to a new, mutually available date within 12 months. If we can't agree on a date within that period, the cancellation terms above apply.
5. The Say Cheese Guarantee™
We back every booking with four written promises:
- We are set up and ready before your first guest arrives.
- A vetted, trained Say Cheese operator runs your event — never a random subcontractor.
- Your gallery is available via QR code from the moment we start, and hosted free for twelve months.
- Your booth runs for every minute of your booked time — if a technical issue interrupts it, we fix it on the spot and add that time back at the end, at no charge.
If we fail to uphold any one of these four promises, you receive a 100% refund of your booking, plus 25% off your next Say Cheese Co. event (transferable to a family member, valid for 24 months). This Guarantee covers the four promises above; it does not apply to matters outside our reasonable control (see clauses 6 and 9).
6. Your responsibilities on the day
So we can deliver safely and run every minute of your time, you agree to ensure:
- a standard power outlet within approximately 3 metres of the booth location;
- a flat, dry, safe space of roughly 3m x 3m for the booth;
- adequate shelter from sun, rain and wind for outdoor setups — the time-extension promise doesn't apply to interruptions caused by weather or power failure outside our control;
- reasonable access to load in and out, with enough setup time before guests arrive;
- any venue permissions required for our attendance and equipment.
If these conditions aren't met and it affects our ability to deliver, the Guarantee promises affected by that failure do not apply.
7. Equipment & damage
All equipment remains our property. You're responsible for deliberate or reckless damage to our equipment caused by you or your guests during the event. We're not liable for delays or non-performance caused by venue, power or access issues outside our control.
8. Photos, galleries & marketing
Your photos are made available via QR code at the event and hosted in your gallery for twelve months, during which you can download them at any time. Guests may choose to enter an email or phone number to receive their own photos — this is used only to deliver their images.
Promotional use: unless you opt out, you grant us a non-exclusive, royalty-free licence to use photographs and video captured at your event to promote Say Cheese Co. This includes our website, portfolio and printed materials, and our social media accounts (for example Instagram, Facebook and TikTok) — including in paid advertising and sponsored posts on those platforms. Content used this way may be reshared by those platforms and their users, and may remain visible after your event.
We never sell your images, and we won't publish a photo alongside your personal contact details. If you'd prefer we don't use any of your event's images, or you want a specific image taken down, just let us know in writing — before your event, or at any time afterwards — and we'll honour it and remove the image from anything we control as soon as practicable. Where an image has already been published or reshared by a third party, we'll make reasonable efforts to have it removed, but can't guarantee copies outside our control are deleted.
Because guests appear in these images, please let us know if anyone attending has asked not to be photographed or featured, so we can respect that on the day.
9. Events outside our control
Neither party is liable for failure or delay caused by events beyond reasonable control — including extreme weather, fire, flood, power failure, illness, accident, government restrictions or venue closure. Where such an event prevents the booking, we'll first offer to reschedule within 12 months; refunds in those circumstances are limited to amounts not already committed to your event.
10. Liability & Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded — those rights prevail over anything here to the extent of any inconsistency.
Subject to that, and to the extent permitted by law, our total liability arising from your booking is limited to the total fee you paid, and we're not liable for indirect or consequential loss.
11. General
These terms and your booking details are the entire agreement between us and replace any prior discussions. Any variation must be agreed in writing (email is sufficient). These terms are governed by the laws of New South Wales, Australia, and the courts of NSW have jurisdiction. Notices may be given by email to hello@saycheeseco.com.au.
12. Acceptance
By paying the Deposit (or otherwise confirming your booking with us), you confirm you've read, understood and agree to these terms, including the deposit and cancellation terms above.
